SUOMISPORT'S TERMS OF USE

1. Scope of the terms of use

These general terms of use (Terms of Use) apply to the Suomisport service (Service), maintained by the Finnish Olympic Committee (Finnish Olympic Committee or Service Provider), the use of the Service, and the related responsibilities, obligations and fees.

3. Usage rights, services and material

The Finnish Olympic Committee grants users (Exerciser) an indefinite, non-exclusive and non-transferable right to use the Service.

The Service allows an Exerciser to manage matters related to themselves, their child, a sports club or a sports federation/association. Through the Service, an Exerciser can purchase, manage and maintain sports licences, club memberships and insurance policies connected to recreational activities, and otherwise manage their information, such as their own or their dependants’ personal information, event registrations and payment information. In addition to the above information, an Exerciser’s merit information stored in the Service is displayed in their account (Sports Account). An Exerciser may also have personal usage rights with organisations, sports clubs and sports federations that use the Service.

4. Use of the Service

An Exerciser can use the Service via an internet connection, either in a browser or a mobile application.

In order to use the Service, an Exerciser must agree to comply with these Terms of Use and use the Service in accordance with these Terms of Use. An Exerciser agrees not to send, transmit or store any material protected by copyright, trademark rights or other intellectual property rights in or through the Service, unless they have permission to do so from the respective rights holder.

An Exerciser may only use the Service for their own or a dependant’s personal reasons through their own or their dependant’s Sports Account. All rights (including all intellectual property rights) of the Service and the content published therein are vested in the Service Provider or other party producing the content. The Service Provider reserves all rights to the content published in the Service and the information generated there, unless otherwise agreed in writing.

Publication or further disclosure of content published in the Service and use for purposes other than those specified in these Terms of Use are prohibited. An Exerciser is not authorised to resell or disclose the content published in the Service to third parties, unless otherwise expressly agreed in writing. When registering in the Service and using the Service, an Exerciser agrees to provide the Service Provider with the correct and appropriate personal information. The Service Provider reserves the right to check the Exerciser’s personal information regularly in order to rectify incorrect, incomplete or outdated personal information.

If the Service Provider has reason to suspect that an Exerciser has not complied with these Terms of Use or applicable legislation, or that the Exerciser has registered in the Service or is using the Service under false personal information or is otherwise misusing the Service, the Service Provider has the right to restrict the use of or right to use the account, to remove the account or usage rights in full or to take any other action it deems necessary.

The Service Provider reserves a unilateral right to remove from the Service any material that does not adhere to these Terms of Use or good practice, or that is illegal or otherwise unsuitable at its discretion.

5. Responsibility and limitation of liability

5.1 Service Provider's responsibility and limitation of liability

The Service is provided as is. The Service Provider keeps the Service in working order and aims to resolve any defects or disruptions in the Service during normal working hours, after receiving a notification of a defect or disruption, within the timeframe it deems appropriate. The Service Provider has the right to suspend the Service temporarily because of a technical modification or renewal or because of installation, modification and maintenance work on the public telecommunications network. The Service Provider aims to keep any interruptions short, so that they will cause as little harm to the Exercisers as possible. The Service Provider also endeavours to issue notifications of any interruptions in advance.

The Service Provider is not responsible for any products (licences, memberships, events and other products offered to the Exercisers in the Service) offered by organisations (sports federations and sports clubs) that use the Service, their content, pricing or delivery to the Exercisers, or any other terms and conditions pertaining to the products. Furthermore, the Service Provider is not responsible for the operation and execution of the payment service embedded in the Service insofar as it falls under the responsibility of the payment intermediary service provider (see Section 6. Terms of payment).

The Service Provider shall not be held liable for any damage caused by the Service’s failure to function, a technical failure in the provision of the Service or if the Service cannot be used on an Exerciser’s devices. The Service Provider is not liable for any indirect or consequential damage resulting from the use of the Service.

Moreover, the Service Provider shall not be held liable for any damage caused by incorrect or incomplete identification or contact information provided by an Exerciser, other information or information on actions that the Exerciser has taken in the Service.

5.2 Responsibilities of Exercisers

The Exercisers are responsible for ensuring that they comply with these Terms of Use. If an Exerciser’s user information and/or usage rights change, the credentials end up in the possession of an unauthorised user or the Exerciser finds that they have unauthorised access to third-party information, the Exerciser is obliged to inform the Service Provider’s customer service department at suomisport@olympiakomitea.fi immediately. An Exerciser is responsible for all actions taken using their credentials, as well as any costs or damage arising from such use, until the Service Provider’s customer service department has changed/suspended the credentials on request.

An Exerciser is responsible for ensuring that their own or their dependants’ personal information that is stored in the Service, such as the Exerciser’s personal identification number, is correct and appropriate. If the information in question is incomplete or incorrect, the Service Provider has the right to prevent the use of that Sports Account. To request that a suspended Sports Account be reopened, contact the Service’s customer service department at suomisport@olympiakomitea.fi.

An Exerciser is always responsible for any damage they have caused to a third party.

6. Terms of payment

The Service can be used to purchase licences, memberships and other products specifically mentioned in the Service. A third-party payment platform is in use for payment transactions, and the Service Provider will not be responsible for any disruptions during transactions.

 

The payment intermediary service is provided to the Service by Svea Payments (business ID: 2121703-0); Mechelininkatu 1 A, 00180 Helsinki; tel. +358 9 321 3300; https://www.svea.com/fi/fi/start/. Products offered in the Service can be paid for through the payment intermediary service using a variety of modern payment methods, such as with a debit or credit card, online payments from Finnish bank accounts and mobile payments. The Service Provider is not responsible for the pricing of the payment intermediary service.

7. Collection of personal information

The Service Provider processes the Exercisers’ personal information in accordance with the requirements of the Service Provider’s privacy policy (link to the privacy policy) and applicable legislation, such as the EU General Data Protection Regulation (2016/679) and the Data Protection Act (1050/2018).

8. Changes to the Terms of Use and the Service

The Service Provider reserves the right to change these Terms of Use or the content and functionalities of the Service. If these Terms of Use are amended in a manner that is significant to the Exercisers, they will be submitted to the Exercisers via the Service for reapproval.

9. Termination of the Service

An Exerciser may terminate the Service by notifying the customer service department at suomisport@olympiakomitea.fi, which will remove their Sports Account usage rights from the Service.

The Service Provider has the right to terminate the use of the Service immediately if an Exerciser violates these Terms of Use.

10. Applicable law and resolution of disputes

These Terms of Use are governed by the laws of Finland, excluding its rules on choice of law. Disputes related to these Terms of Use will be resolved by the Helsinki District Court.
